Obtaining investigation books to the banks
Obtaining investigation books from the inheritance court to investigate the deceased’s funds in Jordanian banks. Note: It is preferable for the heirs to be known to the names of the banks in which the deceased person owns the money in order to shorten the time and effort. These books include a request to transfer the funds for the account of the Amman Inheritance court judge in addition to his job, provided that these books include the release of any deposits and their transfer and the transfer of any checks for the collection fee and the transfer of foreign currencies – it is necessary to know – the books are delivered to the Banking Bureau.
Getting clearance from the Sales Tax department:
It is a must to check with the Income and Sales Tax Department in Jordan to inquire about the value of the amount appropriated on the legacy of the deceased person and explain the reason for the seizure ( if any). There must be a submission of tax statement and declaration through a specialized auditor for the years that the deceased person submitted to the income and sales tax, and as a result, after reaching the final amount in favor of the income tax, the Sales Tax department transfers a letter to the inheritance court to request the due amount .as a result the Inheritance court will transfer the requested amount in favor of the Income and sales tax department via a check. This check is transferred by the judge of the Amman Inheritance court in addition to his position, and the seizure is then released from the deceased’s account. Getting a clearance from the Property Tax. We shall go to Amman Municipality and obtain a clearance for the deceased person from the property tax. Search for the bank accounts:
There shall be a legal search for all 24 banks in Jordan.
After obtaining the clearance from the tax department and the Amman Municipality, we shall provide the banks with a copy of the clearances in order to transfer the amounts to the account of the Amman inheritance court judge in addition to his job. Request for Inheritance court. We shall check with the inheritance court to ensure that the money reaches it, and then submitting a request to divide the legacy. Taking into consideration that the fees for dividing the estate 0.005 of the legacy, provided that it does not exceed 5000 Jordanian dinars. Collecting money. We shall check with the Safety Deposit Box in the banks ( if any) , in which each heir shall receive a check with his money from the inheritance on his/her personal ID. EXTRA legal search. There shall be a legal search for any companies, lands, vehicles, shares in Jordan which might be owned by the deceased person. With regard to Lands, Real estate, and vehicles ( If any) : – They shall be registered in the names of the heirs based on the amended certificate of inheritance in the Land Department and the Traffic Department With regard to companies ( if any) – They shall be registered with the Ministry of Industry and Trade, that the heirs enter this company under the pretext of inheritance through the Ministry of Industry and Trade in Jordan. With regard to shares in the Securities Commission ( if any) : – Their value or profits are transferred to the inheritance court and distributed to the heirs, each according to his inheritance share. With regard to Gold, furniture or Jewelry, or any movable property ( if any) : – It shall be seized through a lawsuit to seize his abandonment, and this lawsuit is submitted to the Amman inheritance court and is sold by public auction and deposited its money in the inheritance court and distributed to the heirs, each according to his inheritance.
Effects of dealing with the Null inheritance certificate.
Effects of dealing with the Null heritage certificate :
According to article 286 of the Jordanian Personal Status Law: The extraction of the inheritance certificate in this way contrary to reality and truth is a crime punishable by the Jordanian Penal Code.
Also, the two witnesses who testified against the null inheritance certificate may be sentenced for false testimony and forgery in association according to Articles 260, 265, and 76 of Jordanian Penal law, because the inheritance certificate was issued based on their testimony.
Also, a complaint by the Sharia Public Prosecutor will be filed against the heirs and witnesses If this matter is revealed to the court and/or the Sharia Public Prosecutor and/or to the inspectors of the Supreme Judge Department and/or any relevant governmental or private entity when the funds are disbursed and/or collected and/or released. Also, any heir from the heirs of any creditor or any person harmed by this matter has the right to file a complaint before the judicial authorities in this regard, and accordingly, everyone may be subjected to the penalties explained previously – unless the heirs make up for this matter.
Correction of the inheritance certificate.
Correction of the Heritage certificate:
If there is any name not list the heritage certificate must be considered null at any time and shall be amended as follows:
We must assist you to file a lawsuit for annulment and rectification of inheritance before the Sharia court in Jordan to nullify the current certificate of inheritance, and as a result, requesting to correct and amend it.
– According to article 284 of the Jordanian Personal Status Law: “ if there is no heir of the deceased person, his movable and immovable estate shall be returned to the Ministry of Endowments and Islamic Affairs and Holy Places”, but since there are heirs to the legacy of the deceased person, his money is not returned to the Ministry of Endowments but is disbursed to the heirs by the inheritance court, as in the event that 15 years have passed since the absentee’s funds his money is returned to the state treasury in Jordan.
